O Tribunal Regional do Trabalho de Campinas (15ª Região) negou ao Banco do Brasil no último dia 27, por unanimidade, suspender a liminar concedida pela 1ª Vara do Trabalho de Campinas ao Sindicato, que proíbe redução de salário do FG (Função Gratificada) migrado para o novo Plano de Funções de Confiança e de Funções Gratificadas, ao julgar mandado de segurança ingressado pelo banco público. Em seu despacho, o desembargador/relator Nildemar da Silva Ramos, conclui que “o plano de cargos e salários, na forma como apresentado…não pode ser posto em prática porque admite a redução de salário ou acréscimo de jornada, sem o correspondente acréscimo remuneratório…”.
Diante dessa decisão favorável ao FG migrado, além de estar proibido de reduzir salário, o BB tem que respeitar a jornada de trabalho de 6h, conforme determinou a juíza Sofia Lima Dutra, da 1ª Vara do Trabalho de Campinas, no dia 3 de abril último, após julgar ação ingressada pelo Sindicato em março deste ano. Em sua sentença, diz a juíza: “…visando resguardar o princípio da intangibilidade salarial, estampado no art. 468 da CLT, concedo a antecipação dos efeitos de tutela para determinar que o Banco do Brasil se abstenha de promover a redução salarial dos empregados substituídos que ingressarem no novo Plano de Funções de Confiança e de Funções Gratificadas instituído em janeiro de 2013, que deverão cumprir a jornada de seis horas com a manutenção da integralidade remuneratória”. Caso o BB descumpra a decisão judicial, será multado em R$ 50 mil por funcionário migrado ao novo plano.
Terceira vitória
A decisão do TRT é a terceira vitória do Sindicato na luta contra o novo Plano de Funções de Confiança e de Funções Gratificadas, implantado unilateralmente no dia 28 de janeiro último. O novo plano, vale destacar, impõe perda salarial de 16% ao chamado público-alvo da Função Gratificada (FG). Inclusive para ‘amenizar’ a redução salarial, o BB autorizou o pessoal FG a realizar horas extras pelo período de um ano. A segunda vitória foi a citada liminar concedida pela 1ª Vara do Trabalho e a primeira aconteceu no dia 31 de janeiro passado, quando a juíza Ana Lúcia Cogo Casari Castanho Ferreira, da 7ª Vara do Trabalho de Campinas, concedeu liminar prorrogando para o dia 6 de março o prazo de adesão, estabelecido pelo Banco para o dia 4 de fevereiro.
